Fairbanks militia leader Schaeffer Cox attempts to serve judge criminal papers

FAIRBANKS — Schaeffer Cox appeared at the Fairbanks courthouse Wednesday morning as scheduled despite saying last week he would treat another court date “like an invitation to a Tupperware party.”

However, Cox, the 26-year-old head of the Alaska Peacemakers Militia, did not address the issue of a trial date on a weapons charge as the hearing was intended to do. He instead attempted to serve criminal papers and a restraining order from a “de jure court” on District Court Judge Patrick Hammers.

He also told an Alaska State Trooper after the hearing the militia has the troopers “outmanmed, outgunned and we could probably have you all dead in one night.” But Cox added he could not see himself shooting someone who lives in the same town as him.

About a half-dozen supporters and members of the militia accompanied Cox at the hearing. Initially, militia member Ken Thesing spoke for Cox, calling himself Cox’s representative and “counsel before God.”

Hammers identified himself as a judge at Cox’ request, which was not enough to dissuade Cox in his belief that the Alaska court system is a for-profit corporation. Cox, who also refused to take off his trademark hat in the courtroom, insists the positions of the state judiciary were never actually filled and the court system is a “pre-processing company” with no jurisdiction over Alaskans.

“You’re now being treated as a criminal engaged in criminal activity and you’re being served in that manner,” Cox said.

Hammers set a trial date of Dec. 28 and a status hearing Monday, then left the courtroom. Alaska State Troopers prevented Cox and his entourage from following the judge into his chambers. Clerks refused to accept the documents for filing because some of the sheets of paper were printed on larger, legal sheets rather than the usual 8-by-11 paper.

Cox, who is facing a misdemeanor weapons misconduct charge for not immediately letting a Fairbanks police officer know he was carrying a concealed weapon last March, has in recent weeks been advocating for the concept of “sovereign citizenship.”

Cox claims he and all Americans are sovereigns, or kings and queens, and no one is required to obey laws unless not doing so would directly harm other sovereigns. Much of his claims center around the belief President Lincoln subverted the original Constitution and replaced it with a copy that incorporated the United States.

Over the summer, the Southern Poverty Law Center released a report estimating that as many 300,000 Americans consider themselves sovereign citizens. The movement has grown with the poor economy, the growth of the Internet and the election of President Obama.

Cox believes the federal government will fail soon and a de jure — or legally established — republic will be at the ready to replace it. Cox also claims to be the chairman of the joint chiefs of staff in the de jure republic.

Following the hearing, Cox, who said he is unsure if he will attend future proceedings, suggested any time he spends in jail could be used to write a book and further spread his views.

“Worst case, I go to jail for 30 days and educate all the prisoners and leave a screaming bee hive behind me,” he said.

As a self-proclaimed sovereign, it sounds like Cox is headed for war with the United States of America. I wouldn't estimate Coxland's chances of victory as being very high.

I am a lawyer who has practiced in the Alaska state courts since 1984. If the Leader believes that the Alaska state courts aren't lawful, he should file papers in the Alaska state courts challenging their jurisdiction over him. If he did that, and he wants people to weigh the arguments he's making, he ought to post those arguments on a website (or give copies to the News Miner for posting) and we can see for ourselves how substantial they seem to be. Mr. Cox?

Sure seems to be a lot of folks doing a lot of gum-flapping without a shred of knowledge involved.

I happened to be one of the spectators at that HEARING this past Wed. morning. Seems the DNM's reporter, Chris Freiberg continued this rag's manipulation of the readers' minds and you continue to let them do it to you!

There was no "entourage" following Schaeffer Cox as he walked through the 'gate' into the court arena and handed his documents to the trooper/acting bailiff in a peaceful manner, asking that those documents be filed into the record, which at that time was refused. The same documents were later filed and stamped as received in the Clerk's office.

As for Cox's supposed statement regarding killing, that again is a mis-interpretation of words by Freiberg and was put into the article as a "statement". Cox's calm and peaceful conversation with the trooper took place at the bottom of the steps on the first floor of the court building. Cox was explaining the real issue of the "incorporation, privatization and for-profit' issues with the Alaska Court System and other agencies of government. He was NOT in a WE KILL, YOU KILL diatribe as was stated in this article.

At times Schaeffer Cox has said things that, in my opinion, should never have been said, especially in a public venue, as anything said reflects on himself, his family, friends and those who associate with him. The so-called 'news' media rarely actually reports the truth about an issue, as that would not be sensational enough for idle minds.

As for the reporters reference to the SPLC (Southern Poverty Law Center), that is pure speculation on the part of Chris Freiberg. He tries to equate 'sovereignty' with the SPLC and nothing on that subject could be further from the truth. That part of his article was simply a repeat of what he wrote in his article that appeared after Cox's Evidentuary Hearing on Dec. 10, 2010.

The REAL issue here should be a LOUD AND UN-ENDING CRY from the people as to the TRUTH of the issues brought forth by Cox as to whether the Alaska Court System is actually a lawful court of the people. There is evidence to the contary and, as this is still purported to be a free country, what's wrong with asking a simple question? It seems to me that if this evidence is in error, it would be simple for the rebut with TRUTH.

Wow you folks have a lot of time on your hands to devote to this misguided lost soul. He is one of many who has confused many issues and events into grand delusions of conspiracies and a government they think they can't trust.

The truth is the government does make mistakes but over all its just good American folks who are working to help keep the peace , the civility and the sanity intact.

Become a student of history and you will see we have had many like this in the past and they always seem to gain more following during the hardest of times. Because people get scared and worried about things they had faith in that seem to of let them down.

Contrary to what they have said and predicted through out history and even recently the world has not come to an end. You may not feel it but Our Great Country has survived , is rebounding and will continue to thrive.

Must we be vigilant yes always. But that includes vigilance against people like this fellow who are misguided and fearful of many of the wrong things. Its a shame he and those like him don't take their energy and use it towards something really constructive like say a good business plan.

Our country , our foundation , our constitution is in good hands and will continue to be. We must be alert against foreign enemies and domestic enemies. But above all we must always find peaceful means for the continue exchange of the leadership that we bestow on them . Through our elections. Not dangerous civil disobedience that would destroy what our founders intended and crafted so wisely.

Now that the little new Buicks are hopefully asleep , I saw part of what is supposedly the audio transcripts through the reporter and there were a few more , kinder words, between Cox and the trooper afterwards. The ending of the statement was omitted as well.

So things appear to be cool between them, that's good , as there are others that would rather kill Cox in the day than to research basic history in the night.
