A retired Air Force lieutenant general who served as head of the 11th Air Force in Alaska has joined those asking questions about the president's birth certificate.

Retired Air Force Lt. Gen. Thomas McInerney, a Fox News contributor, filed an affidavit in the case of an officer who refused orders to go to Afghanistan, arguing that President Barack Obama was not born in the U.S., the website Talking Points Memo said Wednesday.

McInerney  headed the Alaska Command, which included Eielson Air Force Base, 20 years ago. He retired in 1994.

"The affidavit from McInerney acknowledges concerns about Obama's Constitutional eligibility, and demands that he release his birth records or that the court authorize discovery," TPM said.

The website quoted the affidavit as saying:

The President of the United States, as the Commander in Chief, is the source of all military authority. The Constitution requires the President to be a natural born citizen in order to be eligible to hold office. If he is ineligible under the Constitution to serve in that office that creates a break in the chain of command of such magnitude that its significance can scarcely be imagined.

As a practical example from my background I recall commanding forces that were equipped with nuclear weapons. In my command capacity I was responsible that personnel with access to these weapons had an unwavering and absolute confidence in the unified chain of command, because such confidence was absolutely essential-- vital-- in the event the use of those weapons was authorized. I cannot overstate how imperative it is to train such personnel to have confidence in the unified chain of command. Today, because of the widespread and legitimate concerns that the President is constitutionally ineligible to hold office, I fear what would happen should such a crisis occur today.

In refusing to obey orders because of his doubts as to their legality, LTC Lakin has acted exactly as proper training dictates. That training mandates that he determine in his own conscience that an order is legal before obeying it...Indeed, he has publicly stated that he "invites" his own court martial, and were I the Convening Authority, I would have acceded to his wishes in that regard. But thus stepping up the bar, LTC Lakin is demonstrating the courage of his convictions and his bravery. That said, it is equally essential that he be allowed access to the evidence that will prove whether he made the correct decision.

For the foregoing reasons, it is my opinion that LTC Lakin's request for discovery relating to the President's birth records in Hawaii is absolutely essential to determining not merely his guilt or innocence but to reassuring all military personnel once and for all for this President whether his service as Commander in Chief is Constitutionally proper. He is the one single person in the Chain of Command that the Constitution demands proof of natural born citizenship. This determination is fundamental to our Republic, where civilian control over the military is the rule.

According to our Constitution, the Commander in Chief must now, in the face of serious-- and widely held-- concerns that he is ineligible, either voluntarily establish his eligibility by authorizing release of his birth records or this court must authorize their discovery. The invasion of his privacy in these records is utterly trivial compared to the issues at stake here. Our military MUST have confidence their Commander in Chief lawfully holds this office and absent which confidence grievous consequences may ensue..

Now, for the President to maintain paralysis against doing what would be a positive thing for this nation on your grounds that people may react in a way you fear or are concerned about is no different than a child refusing to go to his day of school because the " The teacher might not like me."

You should know that I take no offense having my sanity being brought into question by childish minds. I take it as an unintentional compliment.

If you are referring to my moving the goal with my mention of the COLB, then you struck out miserably. 1) You brought up the COLB, I just responded to it. 2) I said there is argument to it. I didn't say it was my argument. 3) The reason I responded to it was to counter your charge that this question of it's meaning is a product of nutcases , not an indictment of Obama. It is not necessarily the case at all that this question is a product of illogical, irrational thought. You would have to argue that all who can LEGALLY obtain a COLB are required to be natural-born , name of hospital or not. I stated that Hawaii has a messy past concerning issuance of birth documents because that is the truth of the matter , which may be a reason why these questions persist. To portray all who have questions about President Obama's birth status as being ' nutcases ' is just plain dishonest or lazy. However , it is an effective way to avoid addressing real issues, like the I have presented and maintained concentration to with a goal firmly planted in one spot.

Dinner done , full stomach and I'm baaack ...

Now a fact of life is that there will always be skeptics no matter what proof is presented, but to use special pleading in Obama's behalf that somehow, unlike others, he should be immune to it is just that: Special Pleading.

This human phenomena has existed before he was born and will be around after he dies, just like you can't please everyone, fool some of the people all the time, all of the people some of time and can't put 10 pounds of s%&t in a 5 pound bag, but damn ,we try.

mwmcintyre, so President Obama is a helpless victim here ? Interesting concept.

The Slippery Slope fallacy is committed when one projects scenarios that could conceivably or inconceivably stem from the issue at hand to validate an argument to that present issue. Go for the gusto and claim that if the long-form is shown , then there will be those who will want to cage Obama and poke him with firesticks while raping him. If you are going to interject extra drama , get serious about it and combine Slippery Slope with Appeals of Vividness. I think it's possible that whatever is on the long-form could affect how skeptics react. Why not find out ? You can question my sanity , but your the one who is portraying a character straight out of Minority Report. You head must ache with all that soothsaying. I guess I have a problem with those who accept a president who thinks it's more important to say "I don't have to" than it is to put a stop to the many problems because of it.

Curmudgeon, no, scientists assured me there were a couple tortoises there to catch me.

But hey, don't worry about it. Chances are is he will be done in a couple years and slink off into the shadows from whence he came before he will be pinned down to complete this simple ,effortless national stress-relieving task. It's o.k. , I know fear when I smell it. Only two more years to go for that divisive prick.

Buick: You ever gotten on your airboat and headed out to the edge of the ocean? You know, that place where the sun drops out of view and has to circle its way back to the edge of the other ocean before it gets all daylighty again?

I've heard the view is spectacular, but if you aren't careful, your boat will drop off the edge and so will you.

Wait, you already dropped off the edge, didn't you?

So, man is accused(with no evidence) of not being qualified for his elected position. Man provides legal and official proof of his eligibility. People who don't like him demand additional, completely unnecessary proof, he properly ignores them and HE is the bad guy? Still trying to figure out what color the sky is in your fantasy world. Do you criticize rape victims for their choice of clothing for fun in your off time?

PS- the whole bit about people not born on the islands being able to get COLB's is a red herring. The actual location of the birth still has to be listed. And it is. Fact is, no matter what he did, the accusation would just evolve into something different because the only interest in pursuing this is not to find out the truth, it's a self delusional attempt to feel morally superior. If one attack is proven wrong they will either find a way to dismiss the proof or they will change the narrative. In fact it happened.

Also: "I ,however, can accuse you of committing the logical fallacy of Slippery Slope as fact due to your establishment of that fact." -what are you referring to, this statement makes no sense whatsoever.

I swear you're gonna get a hernia, those goalposts are mighty heavy.

Or the long-form will answer that as well as it should, correct?

"Obummer is not a natural born citizen. [It involves possible loyalty conflicts of a person with dual citizenship.]" just-saying

There we go, just-saying proves the point about moving goal posts. At this point it doesn't matter if President Obama produces the documents you want, you'll move on to your new argument that doesn't hinge on his birth certificate.

It's why President Obama quit paying attention the birther lunatics quite a while ago.

That sounds good to me, Invictus .

Just-saying, I was just thinking how messy Hawaii handled foreign-born children concerning home-birth ,adoption, changed parents and guardians, etc. and forgot all about the British Nationality Act.

Yup , disclosing the singular long-form copy would sure clean things up nicely.

You can lead a Repuke to logic but you can't make him think. Arnold Schwarzennegger or what ever that foreign illeagal imigrants name is has no problem because he is a representative of the rightwing nut polished turd party. Poor black man no wonder why they still feel opressed and hate whitie! Relax right wingnuts he is half white you know. NOTE!!!! This Genaral we have lots of dirt on and we will not post it here, Eielson like the rest of the Air Force and other branches of service have their share of radicals in power. Too much power if only the tax payers knew how much the military wastes and not to mention the salaries these Generals make. They are only human and they can be full of it. A retired Lt. Col questioning Obamas linieage or back ground needs to kikeg in his Tea Baggs. He is a white man from land of the invaders of the North American continent so what gives? He's strapped for cash and has gotten greedy and wants to get rich he figures if idiots can put a reject like Bush inot office for 2 terms, destroy the global economy, start a war looking for WMD's without the approval of the people of America (suckers), a former governor from a valley in Alaska #1 meth and quit her job, writes a book and uses the constitution to blab her anoyingly hag mouth, he figures negative publicity is better than no publicity and gets attention. Next thing you know Fox TV will be having nut bags on their network and Limburgers raising the blood pressures of white peopl while he takes his pain killer to cool him down. America is getting to be an IDIOCRACY!

Phishnthegd @ 10:24am: "I still want to see Joe Millers birth certificate..."

A senator is not required to be a natural born citizen, but a president is. If his parents were not both citizens, even if Obummer was born in the USA, Obummer is not a natural born citizen. [It involves possible loyalty conflicts of a person with dual citizenship.]

Check the Constitution, Phish.

Some of you are confused. Miller is not running for POTUS. Nevertheless, I think that Miller should show us his long form birth certificate and challenge Obama to do the same. What's the harm? Further, since we're doing this swingin' pendulus game, I think Miller should show us his Yale transcripts and challenge Obama to show us his Harvard transcripts.

If Obama tells me he's a Christian, born in the USA, a reformed drug-addict, and bisexual, I'll take him at his word.

My argument in a nutshell is that ; yes , it's Obama's fault for not stopping the waste of the courts' time among other more important problems , by doing something with no effort or consequence on his part - unless he is hiding something. But he already established the fact that he is hiding something : His long-form copy. hide - prevent disclosure , conceal , etc.

Seeing that there is argument that a COLB can and has been obtained by those who qualify for citizen status, but who are not natural-born citizens , then there is argument to whether the courts' time is being wasted or not.

Not all legal document are being requested, just one.

You can accuse me of being friends of a bizzaro superman in my universe, but you have no fact to back that up. I ,however, can accuse you of committing the logical fallacy of Slippery Slope as fact due to your establishment of that fact.

So if all neccessary and reasonable legal documents have been produced, and one person continues with litigation that has no basis, then Obama is to blame for wasting the court's time, and not the person trying to litigate a settled issue? Are you good friends with Bizzaro Superman over in your universe?

So out of curiosity Buick, what exactly is the issue? Please tell me precisely what the issue is, because I addressed all the issues with this I could possibly think of. A nice simple straightforward statement of the issue would be nice since all reasonable legal requests regarding this have been satisfied and no even somewhat reliable evidence has been given to the contrary.

Correction: ' wasting the court's time ' with trying to present this issue , which by the way ,could be stopped quite easily by the president himself. he must like to see the court's time being wasted. Tsk, tsk.

Who's trying to restrict free speech AKGOLD? Nobody's saying you don't have the right to say it, just like I have the right to say how tremendously idiotic that viewpoint is. Are you saying you can't handle someone criticizing your viewpoint? Are you saying we have to treat the opposing viewpoint as valid just because someone has it, regardless of the lack of reason and evidence and rationality that viewpoint has? I'm saying the concern over the birth certificate thing is irrational and not based in reality, motivated by a fifth-grade mentality of "My guy didn't win, so I'm going to do everything in my power to discredit the guy who did." Yes, I'm saying you shouldn't have that viewpoint, but I'm certainly not saying you don't have the right to have that viewpoint. Just don't be surprised when I call you out on your lack of sanity for it. Ms. Taitz, Lawyer/Dentist/Real Estate Agent has already been fined thousands of dollars for wasting the courts' time with this issue.

Mwmcintyre, You should know by now that is not the argument, so why continue pretending it is ?

Libelous comments ? Oh really ? Cast doubt ? President Obama needs no help there.

I'll tell you what, go ahead and report these so-called libelous comments . Take it to the top. Tell the president Buick-Mackane sent you.

I care! And many others do too. Regardless of what party someone belongs to, if an office requires that person to be a natural born citizen then that person should be required to file their birth certificate prior to running for that office.
